πŸ“Œ Purpose of the Role

To provide legal and legislative expertise focusing on drafting, reviewing, scrutinizing, and managing financial sector and economic-related legislation on behalf of the Minister of Finance and the National Treasury. This role ensures that all legislative outputs meet high constitutional, technical, and policy standards.


πŸŽ“ Minimum Requirements

  • Grade 12 plus LLB degree

  • LLM (added advantage)

  • Course in Legislative Drafting (advantage)

  • Minimum 4 years legal experience, with 2 years at Assistant Director level

  • Knowledge of:

    • International Law

    • Constitutional Law

    • Administrative Law

    • Interpretation of Statutes

    • Legislative Drafting

πŸ“š Draft and Review Legislation

  • Draft, edit, and scrutinize financial sector and economic-related Bills.

  • Ensure legislation aligns with the Constitution and best drafting practices.

  • Participate in policy development requiring legislative support.

🧭 Oversee Legislative Processes

  • Guide Treasury units on parliamentary and Cabinet legislative processes.

  • Prepare Bills and required documentation for Cabinet and Parliament.

  • Facilitate the entire parliamentary legislative cycle and President’s assent processes.

  • Assist with costing and regulatory impact assessments of draft legislation.

  • Ensure practical, enforceable, and policy-aligned legal frameworks.

  • Assess draft legislation from other ministries affecting the financial sector.

  • Prepare the Minister’s input and highlight potential impacts.

βš–οΈ Draft Regulations

  • Prepare, review, and refine regulations issued by the Minister of Finance.

  • Coordinate comments on regulations requiring concurrence.

  • Ensure regulations align with Treasury laws and constitutional requirements.

  • Audit existing financial legislation for quality, consistency, and policy alignment.

  • Recommend legislative amendments or reforms as needed.

  • Establish strong relationships with:

    • Chief State Law Advisor

    • Parliamentary Legal Services

    • Entities under the Minister of Finance

  • Facilitate communication and collaboration in drafting and legislative processes.

This position plays an essential role in shaping South Africa’s financial regulatory environment. As the Deputy Director, you will work across multiple divisions to ensure laws strengthen financial stability, uphold constitutional rights, and support economic growth. You will be responsible for identifying legislative gaps, contributing to reforms, and ensuring that new Bills and regulations strengthen transparency, accountability, and the proper functioning of financial institutions.

Your input will directly influence national policy direction and support the Minister of Finance in fulfilling legislative obligations. This role requires both technical drafting ability and strategic understanding of the broader financial ecosystem. You will navigate complex legal and economic frameworks, balancing policy intent with legal accuracy to ensure high-quality, defensible legislation.
